processes your personal data. 

Personal data is all information that directly or indirectly relates to natural persons, e.g. name, address, email addresses, etc. This data protection declaration applies to the services offered by the above-mentioned company, which can be accessed under the domain http://lucius.consulting and its various subdomains (hereinafter referred to as "our website"). 

 

General data protection information 

The processing of personal data is necessary for the purpose of advisory activities as well as for customer administration. Furthermore, data are required for submitting offers and drafting contracts. 

We always process your data on the basis of a legal basis within the meaning of Art 6 GDPR as the person responsible and to the extent that this is legally / contractually defined and required for the proper justification and processing of our consulting activities. 

On the basis of any declarations of consent given separately by you, we also use your data to provide further offers from us or from our business partners. For some of our services it is necessary to process specially protected categories of your personal data. This primarily includes (administrative) criminally relevant data that we need, for example, as part of our risk assessment, which forms part of advisory activities. We only process these special categories of personal data in accordance with the statutory provisions and on the basis of your expressly given consent. 

 

Transfer of data to third parties 

Regardless of the specific assignment, please will find a general categorization of our recipients of personal data below: 

  •  IT & service providers used by us as well as other service providers in connection with marketing activities, 

  •  Administrative authorities, courts and corporations under public law, 

  • Accountants, insurance companies on the occasion of the conclusion of an insurance contract for the benefit or in the occurrence of the insured event (e.g. liability insurance), 

  • Clients and customers, insofar as it concerns data of the shareholders, executives and other employees of the respective client and customer, 

  • Cooperation partners and legal representatives working for us, 

  • Other recipients determined by the client and customer (e.g. group companies of the client). 

 

Data retention 

Your data is generally stored for the duration of an ongoing service relationship. In addition, we are obliged to store data in accordance with legal retention requirements. 

Should this exceed the duration of the valid service relationship, the data will be stored as follows in accordance with the statutory provisions: 

  • Obligation to keep books, records and receipts under tax law in accordance with § 132 para 1 BAO: 7 years (beyond that, as long as they are of importance for the tax authorities in pending proceedings), 

  • Retention obligation for companies subject to accounting according to §§ 190, 212 UGB: 7 years, 

  • Storage obligations under sales tax law according to § 18 para 10 UStG (special provision for land): 22 years, 

  • Mandatory statutory retention periods within the scope of foreign group companies. 

 

Data protection and data collection when visiting the website 

The processing of personal data that is transmitted when you visit this website takes place exclusively on the basis of the legal provisions in accordance with the EU General Data Protection Regulation (GDPR) and the Federal Act for the Protection of Natural Persons in the Processing of Personal Data (Data Protection Act - DSG). Our website is basically structured in such a way that no personal data is transmitted to us when you visit the homepage, unless you send us an inquiry using the email address provided. In this case, we will only use the transmitted personal data to process these inquiries. We will not pass this data on to third parties either for a fee or free of charge. Your personal data will only be stored for as long as is necessary to fulfill the purpose for which it was transmitted and this is required by law.
